By accessing and using PCSpecs.io (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. Additionally, when using particular features or services, you may be subject to any posted guidelines or rules applicable to such services.

If you do not agree to these Terms of Service, you are not authorized to use this Service.

PCSpecs.io provides CPU and GPU comparison tools, performance rankings, benchmarks, specifications, and related information (collectively, the "Service"). The Service is provided for informational purposes only to help users compare and research computer hardware.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Our rankings, Performance Index calculations, comparison tools, and aggregated data compilations are our proprietary work. While individual benchmark scores and hardware specifications are factual data, our selection, coordination, arrangement, and presentation of this information is protected by copyright.

You may view, download, and print pages from the Service for your personal, non-commercial use, subject to the restrictions set out in these Terms. You may not modify, reproduce, distribute, create derivative works, publicly display, or exploit any content from the Service without our prior written consent.

All content, rankings, benchmarks, and comparisons provided through the Service are for informational purposes only. They are not professional advice and should not be relied upon as the sole basis for making purchasing decisions.

5.2 No Guarantees of Accuracy
While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, reliability, or timeliness of any content on the Service. Hardware specifications, benchmark data, pricing information, and availability are subject to change without notice.

5.3 Rankings Are Not Definitive
Our performance rankings and Performance Index scores represent our aggregation and interpretation of available benchmark data from multiple sources. They are opinions based on our methodology and should not be considered definitive, guaranteed, or authoritative determinations of hardware quality or performance.

5.4 Individual Results May Vary
Actual hardware performance varies significantly based on numerous factors including but not limited to: system configuration, motherboard quality, cooling solution, power supply, RAM speed and timings, driver versions, BIOS settings, software optimization, ambient temperature, and silicon lottery variations in manufacturing. Benchmark results from our sources may not reflect your individual experience.

5.5 Third-Party Data
We aggregate benchmark data and specifications from third-party sources. We are not responsible for errors, omissions, or inaccuracies in the original source data. Benchmark methodologies, testing conditions, and results may vary between different testing organizations.

5.6 No Professional Relationship
Use of the Service does not create a professional advisory relationship. We are not your financial advisors, technical consultants, or purchasing agents. You are solely responsible for evaluating the suitability of any hardware for your specific needs and making your own independent purchasing decisions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HARDWARE COMPARE, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes but is not limited to damages for:

• Lost profits or revenue
• Loss of data
• Hardware purchased based on information from the Service that does not meet your expectations
• Errors or inaccuracies in content
• Personal injury or property damage resulting from your use of the Service
• Any other damages arising from the use of information obtained through the Service

You acknowledge and agree that you use the Service at your own risk and that you are solely responsible for verifying information from multiple independent sources before making any purchasing decisions.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements
• The accuracy, reliability, or completeness of any information obtained through the Service

You are solely responsible for:

You agree to defend, indemnify, and hold harmless PCSpecs.io and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect by updating the "Last Updated" date at the top of this page.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

It is your responsibility to review these Terms periodically for changes. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

No waiver by PCSpecs.io of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and PCSpecs.io regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and PCSpecs.io.

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Subject to the Arbitration Agreement in Section 16 below, any legal action or proceeding arising under these Terms will be brought exclusively in the courts of England and Wales, and the parties irrevocably consent to personal jurisdiction and venue therein.

16.1 Agreement to Arbitrate
You and PCSpecs.io agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (collectively, "Disputes") will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

16.2 Arbitration Rules and Forum
The arbitration will be administered by a recognized arbitration service provider in accordance with their applicable arbitration rules. The arbitration will take place in England and Wales, or at another mutually agreeable location. The arbitrator's decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

16.3 Class Action Waiver
YOU AND HARDWARE COMPARE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and PCSpecs.io agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

16.4 Waiver of Jury Trial
YOU AND HARDWARE COMPARE WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. You and PCSpecs.io are instead electing to have claims and disputes resolved by arbitration.

16.5 Exceptions to Arbitration
Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies for such a court and remains in such court.

16.6 Opt-Out Right
You have the right to opt out of this arbitration agreement within 30 days of first using the Service by sending written notice of your decision to opt out to the email address provided in our contact information. If you opt out, all other terms of these Terms will continue to apply, but neither you nor we will be required to arbitrate disputes.

16.7 Severability of Arbitration Provision
If any portion of this arbitration agreement is found to be unenforceable or unlawful for any reason, (a) the unenforceable or unlawful provision shall be severed from these Terms; (b) severance of the unenforceable or unlawful provision shall have no impact whatsoever on the remainder of the arbitration agreement or the parties' ability to compel arbitration of any remaining claims on an individual basis; and (c) to the extent that any claims must therefore proceed on a class, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration.
